Understanding your obligations and rights when a tenant requests an Emotional Support Animal accommodation.
Four core principles that govern every ESA accommodation request.
The Fair Housing Act (42 U.S.C. § 3604) requires housing providers to make reasonable accommodations for tenants with disabilities — including allowing Emotional Support Animals even in no-pet buildings. This is a federal civil rights obligation, not a courtesy.
If a tenant's disability is not obvious, you may request reliable documentation showing (1) the person has a disability and (2) the ESA provides disability-related therapeutic benefit. You may NOT request specific diagnoses, medical records, or require the letter come from a specific provider.
ESAs are not pets under federal law. You may not charge a pet deposit, pet rent, or any additional fee because of an ESA. However, you retain the right to recover actual damage costs caused by the animal — the same standard that applies to tenant-caused damage generally.
Your standard breed or size restrictions — whether imposed by your own policy or by an insurer — cannot be used to deny a qualifying ESA. The HUD 2020 guidelines explicitly state that breed, size, and weight restrictions do not apply to ESAs when a valid accommodation request is made.
