ESA Housing Rights in New York

New York has some of the strongest ESA housing protections in the country. The New York State Human Rights Law supplements federal FHA protections, and NYC provides additional local protections through the NYC Human Rights Law. Landlords must make reasonable accommodations for ESA owners, and housing discrimination complaints are handled by the NY Division of Human Rights.

Landlord Rules in New York

Cannot charge pet deposits or pet rent for documented ESAs under NY Human Rights Law
Must make reasonable accommodations even in no-pet housing, including DHCR-regulated units
Cannot impose breed, size, or weight restrictions on ESAs
May request ESA documentation but cannot demand detailed medical records
NYC landlords must also comply with the NYC Human Rights Law for additional local protections
Cannot retaliate against tenants who request ESA accommodations
