Do ESA Letters Expire?
Yes. Most ESA letters are valid for one year from the date of issuance. This isn't a legal requirement set by the Fair Housing Act — the FHA doesn't specify an expiration period for ESA letters. But the one-year standard has become industry practice for two reasons:

If you're renewing with the same provider:
- Contact your original provider and request a renewal evaluation

- Receive your updated ESA letter
If you're renewing with a different provider:
- Find a licensed mental health professional in your state (telehealth or in-person)
- Complete a full intake and evaluation

- The new provider will issue a fresh ESA letter after their own independent assessment

What Happens If Your ESA Letter Expires?
If your ESA letter lapses and you haven't renewed it, a few things can happen:
Your current landlord may request updated documentation. If you're in the middle of a lease and your letter expires, your landlord can ask for a current letter. Most won't proactively check, but if any issue arises — a complaint, a lease renewal, an inspection — an expired letter weakens your position.
A new landlord can reject an expired letter. If you're applying for new housing and present an ESA letter that's more than a year old, the landlord is within their rights to ask for current documentation.
You don't lose your ESA. An expired letter doesn't mean your animal is no longer an ESA or that you've lost your rights. It means you need to get updated documentation to enforce those rights. Your underlying condition and the therapeutic benefit of your animal haven't changed — you just need current clinical verification of that.
You should not be evicted solely for an expired letter. A landlord cannot evict you mid-lease simply because your ESA letter expired. They can request updated documentation, and you should provide it promptly. But failure to immediately produce a renewed letter is not grounds for eviction if you're otherwise in compliance with your lease and accommodation agreement.
Can a Landlord Require Annual Renewal?
This is a gray area. The FHA doesn't give landlords the explicit right to demand annual renewal of ESA documentation. However, HUD guidance does allow landlords to request "reliable" documentation, and an old letter may not meet that standard.
In practice, most housing providers ask for updated documentation annually, particularly during lease renewals. Rather than fight this, it's simpler and safer to keep your letter current. Annual renewal protects you by ensuring you always have documentation that's beyond question.
